The ProPer Commission on Judicial Performance is not an official commission. We are concerned citizens addressing the problem that primary function for most official bodies (e.g., the California Commission on Judicial Performance) is to protect judges from public complaints instead of disciplining wrongdoing by judges.

Complaints by citizens should not be treated as "top secret" in order to protect the judges.

A judge's error in a decision or ruling -- by itself -- is not misconduct. Appeal may be the only remedy for such an error, or there may be no remedy. Orders as to custody, visitation and setting child support, as well as fines and sentences in traffic or criminal cases -- if not outside the parameters set by law -- are generally within the discretion of the trial court and are not usually matters for the commission. The California Supreme Court has determined that a judge who commits legal error is subject to investigation and possible discipline only if the legal error clearly and convincingly reflects in addition bad faith, bias, abuse of authority, disregard for fundamental rights, intentional disregard of the law, or any purpose other than the faithful discharge of judicial duties.
